Supreme Court throws out Korean war veteran's death sentence

PTSD must be considered by a jury, the justices rule for the first time in a Florida case in which murderer George Porter's own lawyer didn't know he served in the Army, earning two Purple Hearts.

Reporting from Washington - The Supreme Court on Monday threw out a death sentence for a decorated Korean War veteran, ruling for the first time that combat stress must be considered by a jury before it hands down the harshest punishment.

"Our nation has a long tradition of according leniency to veterans in recognition of their service, especially for those who fought on the front lines as [George] Porter did," the justices said in a unanimous, unsigned opinion. "Moreover, the relevance of Porter's extensive combat experience is not only that he served honorably . . . but also that the jury might find mitigating the intense stress and mental and emotional toll that combat took on Porter." George Porter Jr. was convicted in the 1986 shooting deaths of his ex-girlfriend and her then-boyfriend in Florida during a drunken rage. But the jury that sentenced him was never told -- and his appointed lawyer did not know -- of his military service more than three decades earlier...>>>>>

Congressman Filner Bill Allows Elderly Veterans to Use Earned Medicare for VA Health Care

“There are veterans who have earned VA health care benefits with their service to our country,” stated Chairman Filner. “They have also earned Medicare benefits by contributing to the Medicare program during their working years. Because VA cannot bill Medicare, elderly veterans are unable to use their Medicare benefits, even if they may prefer to receive care at a VA facility among their fellow veterans. So for those veterans, they basically forgo the hard-earned dollars that they contributed towards Medicare benefits during their working years. H.R. 3365 is an important bill that would allow elderly veterans to access both VA health care and their Medicare benefits.”

Veterans Administration begins effort to help keep arrested veterans out of future trouble

Bracing for an influx of soldiers returning from Iraq and Afghanistan, the Department of Veterans Affairs has launched an ambitious effort to locate veterans who've had minor brushes with the law and offer them treatment to try to prevent repeat crimes.

The VA started its Veterans Justice Outreach Program early this year — before public attention intensified on a handful of Fort Carson, Colo.-based soldiers accused of murder, attempted murder or manslaughter after returning from a deployment where they faced intense combat. Most of the soldiers had been arrested for domestic violence, assault, illegal gun possession, and alcohol and drug charges before the slayings...........

A total of 303,223 veterans were included in this analysis. The mean age of the study population was 31 years and 88% were men. PTSD was common among the cohort (24% prevalence). Among those with PTSD, comorbid mental health conditions were prevalent including depression (53%), anxiety disorder (29%), adjustment disorder (26%), and alcohol use disorder (22%)...........................

Democrats blast Army's handling of toxic exposures in Iraq

Sen. Byron Dorgan, D-N.D., called the Army's response to soldiers exposed to a highly toxic carcinogen in Iraq "inadequate" and said the Democratic Policy Committee will request a report from the Pentagon's inspector general on the matter.

Five soldiers who served at an Iraqi water injection facility in 2003 testified before the committee on Monday, outlining symptoms believed to be the result of exposure to sodium dichromate spread across the facility.................

1. What happened?

• An audit of mail processing procedures at four Veterans Adminstration regional offices by VA's Office of Inspector General (OIG) found 36 claims documents had been inappropriately placed in shred bins for disposal. VA immediately ceased all shredding activities while a nationwide review was conducted of all documents in shred bins. Approximately 500 documents that could potentially affect a claimant's entitlement to benefits were found improperly placed in shred bins at various regional offices. These regional offices are taking appropriate action on all of the documents found.

VA program to schedule patient appointments on verge of collapse

The Replacement Scheduling Application Development Program, which VA began building in 2001, "still has not developed a single scheduling capability it can provide to the field, nor is there any expectation of delivery in the near future," wrote Dr. Michael Kussman, undersecretary for health at the Veterans Health Administration, in a March 20 memo to Stephen Warren, acting assistant secretary for information and technology.

The botched effort comes on the heels of another scheduling program -- a five-year, $75 million failed project started in 2001.

"VA has a decade-long history of initiating IT programs, only to experience extensive delays and major cost overruns," said Gerald Manar, deputy director of the National Veterans Service at the Veterans of Foreign Wars. "The fact that VA has frittered away eight years and millions of dollars in developing the RSA, with no viable results and no end in sight, is extremely disappointing but, based on its track record, not surprising."

Every Memorial and Veterans' Day, elected officials praise veterans and the sacrifices they have made while in uniform. However, that sacrifice does not end when they return home to their families and communities.

For many veterans, the hardest and most enduring sacrifice begins the moment they return home. The combat load they shouldered for their country endures long after war is over.

For most, it lasts a lifetime.

This is especially true in New York.

New York has sent over 70,000 troops to Iraq and Afghanistan and has the fourth largest veteran population in the country. Overall, there are almost 12,000 service members from the state currently deployed in both the Iraq and Afghanistan theaters of combat, many of whom are from the New York City area.

However, six years into the war in Iraq, and eight into the war in Afghanistan, many Active Duty, Reserve and National Guard veterans have come home to a city administration that does a lot of talking and thanking but nothing, other than a breakfast at Gracie Mansion on Veterans' Day, in terms of actual, tangible services. >>>>>Rest Here

VA: A Bureaucratic Mess, DeJa-Vu

We've seen this before, especially us "Nam Vets as we returned, tens of thousands, and those needing and seeking the care from their service in a war became backlogged, or just plain denied. Many of us veterans were trying to be heard, over the rising drum beat of war, of what was coming especially if invading a country that did absolutely nothing to deserve that invasion and occupation. We were one of those groups politically labeled, by our hired administration, as a 'focus group' that they didn't listen to. But it wasn't only the administration not listening it was the greater majority of this country, they don't mind spending billions upon billions upon billions........... on the war machine and waging war with same, but when the soldiers start returning and the system gets overwhelmed the country doesn't want to hear anything about that, or if they hear they most certainly don't want to pay..

The Veterans Administration has really never been perfect, nothing is, but in a once supposedly rich society it always could have been better, much better. During the years of basically no conflicts it ran fairly well but than the country got what it deserved, for eight years a totally incompetent administration and congress, the proof has been witnessed over and over, more than willing to show the countries might and in doing so, with the drums of war beating louder and louder, never once mentioning nor acting on enhancing the agencies that will be taking care of not only the active wounded but the veterans of two invasions and occupations even as the problems started surfacing. It wasn't only the political leadership but also the country as a whole, No Sacrifice!

Under the leadership of the previous Commander in Chief of the Military Forces, the President, with a willing Congress and the Country, more and more is coming to the surface of the total incompetence and apathy!

CBS Evening News: Missing Files, Unopened Mail, Deliberately Misdated Forms Revealed By Inspector General

Iraq War veteran Jason Scott is one of thousands who have endured disastrously poor health care coverage from the Veterans Affairs Administration, which lost his health files, and, according to an inspector general's audit, is sitting on 16,000 pieces of unopened mail in a single office.

All too often, our veterans feel like they're David battling Goliath, when dealing with the Department of Veterans Affairs.

In the latest outrage involving the VA, it turns out thousands of claims for benefits weren't even opened, reports CBS News correspondent David Martin.

Jason Scott is one of nearly 350,000 veterans of Iraq and Afghanistan who depend on the VA for health care. When CBS News met him two years ago, he was already worrying about what would happen after he was discharged from the army.

Although veterans were not directly harmed by this practice, since the effective date of a claim was logged correctly in a different system, perpetrators of this kind of dishonestly impact the entire veteran community’s ability to trust the institution charged with its welfare. This is shameful!”

National Council on Disability Says More Needs to be Done for Service Members and Veterans with Post Traumatic Stress Disorder and Traumatic Brain Injury

WASHINGTON—The National Council on Disability (NCD) today released a report recommending changes in the continuum of health care provided to service members and veterans with Post Traumatic Stress Disorder (PTSD) and Traumatic Brain Injury (TBI).

The report, Invisible Wounds: Serving Service Members and Veterans with PTSD and TBI - doc, addresses those concerns and makes 10 recommendations.

Unopened claims letters hidden at VA offices

A new report about Veterans Affairs Department employees squirreling away tens of thousands of unopened letters related to benefits claims is sparking fresh concerns that veterans and their survivors are being cheated out of money.
VA officials acknowledge further credibility problems based on a new report of a previously undisclosed 2007 incident in which workers at a Detroit regional office turned in 16,000 pieces of unprocessed mail and 717 documents turned up in New York in December during amnesty periods in which workers were promised no one would be penalized.
“Veterans have lost trust in VA,” Michael Walcoff, VA’s under secretary for benefits, said at a hearing Tuesday. “That loss of trust is understandable, and winning back that trust will not be easy.”

Kathryn Witt of Gold Star Wives of America said survivors trying to receive VA benefits have long complained about problems getting accurate information and missing claims. “When they call to check on the status of the claim, they are often told that the VA has no record of their claim and that they should resubmit their paperwork,” she said.
In one case, a woman claimed she had to submit paperwork to VA three times to prove she was married and had three children, Witt said.
And having to resubmit the same claim, she added, does nothing to reduce the backlog that already forces survivors to wait six to nine months for simple claims to be approved.

Wartime brain injuries could reach 360,000

About 20 percent of troops suffer head trauma, Defense Dept. doctors say

WASHINGTON - The number of U.S. troops who have suffered wartime brain injuries may be as high as 360,000 and could cast more attention on such injuries among civilians, Defense Department doctors said Wednesday.

The estimate of the number injured - the vast majority of them suffering concussions - represents 20 percent of the roughly 1.8 million men and women who have served in Iraq and Afghanistan, where blast injuries are common from roadside bombs and other explosives, the doctors said.

Duckworth Tapped for VA Assistant Secretary

WASHINGTON – President Barack Obama has announced his intent to nominate L. Tammy Duckworth, director of the Illinois Department of Veterans Affairs, to be the Assistant Secretary of Public and Intergovernmental Affairs for the Department of Veterans Affairs (VA).

As assistant secretary, Duckworth will direct VA’s public affairs, internal communications and intergovernmental relations. She also will oversee programs for homeless Veterans, consumer affairs and special rehabilitative events.

Veterans offered health care help

For veterans struggling financially because of a job loss or decreased income, the U.S. Department of Veterans Affairs offers programs that can relieve the costs of health care or provide care at no cost.

Veterans whose previous income was ruled too high for VA health care may be able to enter the system based on a hardship if their current year's income is projected to fall below federal income thresholds because of a job loss, separation from service or some other financial setback. Those eligible due to hardship can avoid co-pays applied to higher-income veterans. Qualifying veterans might be eligible for enrollment and receive health care at no cost.

Also eligible for no-cost VA care are most veterans who recently returned from a combat zone.

Halvorson speaks on veterans' affairs

"I also believe that the veterans' issues are going to be a huge priority for me," Halvorson said, immediately acknowledging concerns. "The last administration has created so many veterans, it's going to be up to us to figure out a way to make sure that they're a top priority and that we are ready for them when they come home…"

America’s Wounded Warriors March on Washington, DC

Responding to President Obama’s call for all Americans to get more involved, America’s Wounded Warriors from across the country will converge on Washington, D.C. the second week of February, 2009 to meet with their Senators and Members of Congress. The most prominent of these will be the Purple Heart Medal worn on their lapel, the symbol of dedicated service to the country.

Advisory committees are used extensively by the Department of Veterans Affairs (VA) to provide advice and guidance on a wide variety of programs that deliver benefits and services to our Nation’s veterans. Advisory committees operate as another component of the “people’s voice” in our democratic form of government. Some of VA’s advisory committees have been mandated by Congress to ensure that federal laws, as carried out by the executive branch, are meeting their intended goals. Other VA committees have been created by the Secretary of Veterans Affairs to assess specific VA policies or programs.

Advisory committee members are generally acknowledged, by VA’s leadership and members of the veterans affairs committees in Congress, as “consumer representatives” of those millions of beneficiaries whose lives are affected each year by VA programs. Advisory committees must operate in compliance with the Federal Advisory Committee Act (FACA). Advisory committee meetings at VA are generally open to the public, and notices of those meetings are published in the Federal Register.

One of VA’s principal objectives in managing its advisory committees is to ensure that committee members appropriately reflect the diversity of American society and the veterans’ population. Committee members are expected to have the technical, scientific and programmatic expertise demanded by the committees’ areas of interest and emphasis. Committee members are also expected to offer unbiased advice and to comply with all federal ethics standards.

This week, the American Federation of Government Employees (AFGE) launched a nationwide radio ad campaign raising serious concerns about Senator McCain's commitment to veterans' health care. In addition to the radio ads, AFGE, which represents employees in the Department of Veterans Affairs, launched a Web site, Fund The VA, and a series of YouTube ads featuring union veterans voicing their concerns about McCain's controversial veterans health care platform.

The only way anything has gotten done, for those who make the riches for others, the worker, is through organizing! While our Capitalists system is not supposed to have developed that way, It Has! And with the use of fear, and law, those who reap the power, and wealth, have successfully beat down the orginizing of the worker seeking the better conditions and what is right for a truely successful economic climate.

This fight for what the Country owes those who Serve It has been extremely long and marked with failures, few successes, for those fighting it!

The U.S. Department of Veterans Affairs may paint a rosy picture of improving healthcare for veterans, but the agency has systematically denied benefits to sick veterans and delayed claims so long that many of them commit suicide, a lawyer for two advocacy groups argued in federal court Monday.

VA stalling on care, judge told at S.F. trial

More than 120 veterans of the wars in Afghanistan and Iraq commit suicide every week while the government stalls in granting returning troops the mental health treatment and benefits to which they are entitled, veterans advocates told a federal judge Monday in San Francisco.
